SAN FRANCISCO (AP) — Attorneys for FedEx are set to appear in court, as they seek to dismiss a federal indictment that accuses the company of knowingly shipping illegal prescription drugs from two online pharmacies.
A federal judge in San Francisco is scheduled to hear arguments Thursday on FedEx’s motion. The Memphis, Tennessee-based shipping giant says transportation companies such as FedEx cannot reasonably be expected to police the millions of packages they ship each day. FedEx, additionally, says federal law includes exemptions that allow carriers to possess controlled substances.
Federal prosecutors dispute FedEx’s interpretation of the law as overly broad and say it does not allow distribution of drugs.
They have charged FedEx with multiple conspiracy and drug counts and also accuse the company of money laundering. FedEx has pleaded not guilty.
